American Entrepreneur Claims He Was Defrauded in Paraguay

A criminal investigation underway in Ciudad del Este, Paraguay, has attracted international attention after an American entrepreneur accused executives of the pharmaceutical company Indufar C.I.S.A. of fraud, breach of trust, and criminal conspiracy. According to the complaint, the losses suffered by the investor exceed $4 million.

At the center of the dispute is tirzepatide, the active ingredient in Mounjaro, currently the world’s leading weight-loss medication. Seeking to capitalize on the growing market for anti-obesity drugs, the U.S.-owned company Bem Estar Distribuidora S.A., which has been operating in Paraguay for four years, entered into a partnership with Indufar to develop a generic version of the medication in accordance with local regulations.

As alleged, Bem Estar shared proprietary information under the protection of a confidentiality agreement, including technical specifications, business strategies, sales projections, and customer data. Prosecutors claim that the information was later used to block the registration of an exclusive trademark, alter the product’s presentation, and ultimately remove the American company from the venture.

Authorities estimate that the resulting losses reduced the company’s revenue by nearly 80 percent and left it with an inventory of more than 20,000 unsold units.

The defendants include Indufar directors Óscar Humberto Simón Palmerola and Cynthia Montserrat Ríos Villagra, as well as executives Darío Alejandro Zanin and José Luis Rodríguez Paredes. They have not yet publicly responded to the allegations.

The case is unfolding at a crucial moment for Paraguay, which has been promoting itself as a destination for foreign investment. The country has become an important center for pharmaceutical production because of favorable regulations and tax incentives. However, questions surrounding intellectual property rights, trademark protection, and contract enforcement could affect international confidence in the country’s business environment.

As the proceedings move forward, investors across the globe will be closely watching the outcome.
